Terms of Service

Effective date: September 12, 2025

These Terms of Service ("Terms") govern your access to and use of ImageDesigner.AI’s image generation service and related websites, apps, and APIs (collectively, the "Service"). By using the Service, you agree to these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Service.


1. The Service

The Service lets you generate images from prompts and/or uploaded files using third‑party model providers. You choose which model to use for each request. Your prompts, uploads, and settings are sent to the selected provider to generate outputs.

Third‑party model providers currently integrated:

  • OpenRouter (routing to various models, including Gemini Image Models)
  • OpenAI (image models)
  • FAL (various image models)

We may add or remove providers over time.

2. Eligibility & Accounts

  • You must be at least 16 years old (or the age of digital consent in your country, if higher). Outside the EEA/UK, you must be at least 13.
  • If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account.

3. Your Content & Generated Outputs

3.1 Definitions

  • User Content means prompts, text, settings, images, and other materials you submit to the Service.
  • Outputs means images and other materials generated by the Service in response to User Content.

3.2 Ownership

  • As between you and us, you retain ownership of your User Content.
  • Outputs. Subject to Section 3.3 (Provider Terms) and applicable law, we assign to you all right, title, and interest we may have in the Outputs. You are responsible for how you use the Outputs, including ensuring any use complies with applicable law and third‑party rights.

3.3 Provider Terms May Apply

Outputs may be subject to the terms of the third‑party model provider you select (e.g., OpenAI, OpenRouter, FAL or their upstreams). If a provider’s terms conflict with these Terms, the provider’s terms govern for requests processed by that provider. You are responsible for reviewing those terms and privacy policies before using a provider.

3.4 License to Operate the Service

You grant us a worldwide, non‑exclusive license to use, reproduce, process, and display your User Content and Outputs solely to provide and maintain the Service, troubleshoot, secure, and comply with law. We do not use your User Content or Outputs to train our own models unless you explicitly opt in.

3.5 Similarity and Non‑exclusivity

Due to the nature of generative models, other users may receive similar outputs. We do not guarantee exclusivity, novelty, or non‑infringement of Outputs.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any law or third‑party rights (including IP, privacy, or publicity rights).
  • Generate or upload content that is illegal, exploitative, or harmful (e.g., CSAM; non‑consensual intimate imagery; encouragement of violence; extremist or terrorist content).
  • Generate content that is defamatory, deceptive, or intended for impersonation or fraud.
  • Submit or attempt to produce content that requires special handling or professional regulation (e.g., medical, legal, or financial advice) as authoritative outputs.
  • Reverse engineer, probe, or misuse the models or infrastructure; interfere with or disrupt the Service; exceed rate limits; or bypass security or usage controls.
  • Use Outputs to train competing models without the express permission of the applicable provider where required.

We may investigate and suspend or terminate accounts for suspected violations.

5. Privacy & Data Processing

Summary: We do not collect personal information beyond what is necessary to fulfill your requests or technically required to operate the Service. We send your User Content to the third‑party provider you select to generate Outputs. Processing occurs in the United States (and other locations of the selected provider), and the handling of your data at the provider is governed by that provider’s privacy policy.

5.1 Data We Process

  • Operational data: account credentials, email, billing identifiers, session tokens.
  • Technical logs: IP address, timestamps, device/browser metadata, error logs, usage metrics, and security signals.
  • Request data: prompts, uploads, parameter settings, and necessary metadata to fulfill the request.

We do not sell your personal information. We do not build marketing profiles from your prompts or Outputs.

5.2 Third‑Party Providers

When you choose a model, your request (including User Content) is transmitted to the chosen provider and processed under that provider’s terms and privacy policy. By selecting a provider, you direct us to send your data to that provider. Current providers include:

  • OpenRouter (routes to multiple model providers, including Google’s Gemini image models)
  • OpenAI (image generation models)
  • FAL (various image models)

Links to each provider’s current privacy policy will be posted in our Privacy Notice (or you may consult their websites directly). Providers may store logs for abuse prevention, debugging, and legal compliance.

5.3 International Transfers

Your data will be processed in the United States, the European Union (EU), and possibly other jurisdictions where providers operate. If your data is transferred outside your region (e.g., from the EEA/UK/Switzerland to the United States), we rely on appropriate transfer mechanisms (e.g., Standard Contractual Clauses) for such transfers.

5.4 Legal Bases (EEA/UK)

We process personal data on the bases of (i) performance of a contract (to provide the Service), (ii) legitimate interests (security, debugging, preventing abuse), and (iii) consent where required by law.

5.5 Retention

We retain operational and log data for the minimum period necessary to provide the Service, secure our systems, comply with legal obligations, and resolve disputes. Request and Output data may be retained for a limited time for troubleshooting and safety (unless you delete it or request erasure, where applicable). Providers may have their own retention periods.

5.6 Your Rights

Depending on your location, you may have rights to access, correct, delete, or export your personal data, and to object or restrict processing. To exercise rights, contact us at [email protected]. You may also contact the relevant provider for data they process as an independent controller.

5.7 Security

We implement reasonable technical and organizational measures to protect data; however, no system is perfectly secure. You are responsible for safeguarding your account credentials.

6. Payment, Credits, and Taxes

If the Service uses paid plans or credits, fees and billing terms will be presented at checkout or in your account. All purchases are final unless stated otherwise in the applicable offer or required by law. You are responsible for any taxes, duties, or government charges.

7. Availability and Support

We strive for high availability but do not guarantee uninterrupted Service. Providers or upstream networks may experience outages or rate limits that impact results or latency. Support channels and response times are provided on our website.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for any breach of these Terms, misuse, non‑payment, or where required by law. Upon termination, your license to use the Service ends, but Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnities) will survive.

9. Intellectual Property and Takedowns

We respect intellectual property rights. If you believe content or Outputs infringe your rights, send a detailed notice to [email protected]. For U.S. DMCA notices, include all elements required by 17 U.S.C. §512(c)(3). We may remove content and, where appropriate, disable repeat infringers.

10. Disclaimers

THE SERVICE AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ERROR‑FREE, UNIQUE, OR SUITABLE FOR ANY SPECIFIC PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR PROVIDERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR €100 IF YOU HAVE NOT PAID ANY AMOUNTS).

Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the fullest extent permitted by law.

12. Indemnification

You will defend and indemnify us and our affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your User Content or use of Outputs; (b) your violation of these Terms or applicable law; or (c) your infringement or misappropriation of any rights of a third party.

13. Changes to the Service or Terms

We may modify the Service and these Terms. If changes are material, we will provide notice by posting to our site or via email. Changes take effect upon posting unless stated otherwise. Your continued use after changes take effect constitutes acceptance.

14. Governing Law; Venue

These Terms are governed by the laws of Germany, excluding its conflict‑of‑laws rules. The courts located in Heidelberg will have exclusive jurisdiction, and you consent to their personal jurisdiction.

If you are a consumer resident in the EEA/UK, mandatory consumer protection laws and dispute venues of your residence may also apply.

15. Export and Sanctions Compliance

You agree to comply with all applicable export control, sanctions, and anti‑boycott laws, including the EU and UK sanctions regimes and, where applicable, the U.S. Export Administration Regulations (EAR) and regulations administered by the U.S. Office of Foreign Assets Control (OFAC).

You represent and warrant that you: (a) are not located in, organized under the laws of, ordinarily resident in, or controlled by any country or region subject to comprehensive sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine); (b) are not listed on, and are not owned or controlled by any person listed on, any applicable restricted‑party list (e.g., the EU Consolidated List, UK Sanctions List, U.S. Specially Designated Nationals or Consolidated Screening List); and (c) will not use the Service for any prohibited end use or for the benefit of any prohibited end user.

You further agree not to export, re‑export, transfer, or otherwise make available the Service or Outputs in violation of these laws, including for activities related to nuclear, missile, or chemical/biological weapons proliferation, or to military end users or end uses prohibited by law.

16. Miscellaneous

These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements. If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. No waiver is effective unless in writing. No agency, partnership, or joint venture is created by these Terms.

Annex A — Privacy Notice (Short Form)

This Privacy Notice summarizes key data practices for the Service. For full details, see Section 5 of the Terms or our standalone Privacy Policy.

  • What we collect: Only what is necessary to fulfill your requests or technically operate the Service (account data, logs, and your prompts/uploads/settings). We do not sell personal information.
  • Where data goes: To the model provider you choose (OpenRouter → Gemini and others; OpenAI; FAL). They process your request under their own privacy policies and may store logs for abuse prevention and legal compliance.
  • Where processed: The United States (and other provider locations). For EEA/UK users, transfers rely on mechanisms like Standard Contractual Clauses.
  • Retention: Minimal periods to operate, secure, and comply with law. Providers have their own retention.
  • Training: We do not use your content to train our models unless you opt in. Providers may have different policies—review theirs before use.
  • Your rights: Access, delete, correct, export, object/restrict (where applicable). Contact [email protected]. You may also contact the provider directly for data they control.
  • Security: Reasonable organizational and technical measures; no system is perfectly secure.
